A man, who cannot be named for legal reasons is set to appear before Castlerea District Court on three counts of sexual assault, contrary to Section 2 of the Criminal Law (Rape) (Amendment) Act 1990 as amended by Section 37 of the Sexual Offences Act 2001.
Reporting restrictions were sought by both Gardaí and the accused’s solicitor when he appeared before a previous court sitting.
The court was told the defendant was arrested on the morning of the court,
At a previous court sitting, Sergeant Paddy McGirl said directions had been received from the Director of Public Prosecutions, which was for trial on indictment on all matters. A number of conditions were imposed by the court, namely that he resides at the address as listed on his charge sheet and is to have no contact, directly or indirectly with the injured party.
He was also required to provide a mobile phone number and to sign-on at his local Garda Station on a specific day between the hours of 9 a.m. and 9 p.m. because of what Sergeant McGirl said were “the seriousness of the charges”.
Sergeant McGirl applied for the accused to be remanded on bail to appear before the November 20th sitting of the court by which time the Book of Evidence will be ready.
An application for Legal Aid on behalf was granted by Judge Mitchell.
